OVERVIEW This Website is operated by Hypley PTY LTD. This Website is provided solely to assist customers in gathering information, determining the availability of goods and services, making legitimate bookings or otherwise transacting business with suppliers, and for no other purpose (together the “Services”). Throughout the site, the terms “we”, “us” and “our” refer to Hypley or Hypley (trademark). The term “you” refers to any person visiting the Website and using or seeking to use any of our Services.
The information contained on this Website constitutes an invitation to treat and is not acceptance by you. Any booking made or order placed by you shall be deemed to be an offer made by you to purchase the relevant products or services subject to this Agreement and any booking or carriage conditions of the relevant supplier. You acknowledge and agree that this Agreement constitutes a valid and enforceable contract only once payment has been processed electronically and your booking confirmed by Hypley.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
The headings used in this Agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 2 – WEBSITE AND CONTENT The content and information on this Website as well as the infrastructure used to provide such content and information, is proprietary to us or our suppliers and providers. Accordingly, as a condition of using this Website, you agree not to use this Website, its contents or information for any commercial or non-personal purpose (direct or indirect). While you may make limited copies of your reservations booked through this Website, you agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, licence, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from this Website. In addition, you agree not to use this Website for fraudulent, abusive or suspicious activities. If your booking or account shows signs of fraud, abuse or suspicious activity, Hypley may cancel any reservations associated with your name, email address or account, and close any associated accounts. In addition, we may verify (i.e. preauthorize) your credit card. If you have conducted any fraudulent activity, Hypley reserves the right to take any necessary legal action and you may be liable for monetary losses to Hypley, including litigation costs and damages. To contest the cancellation of a booking or freezing or closure of an account, please contact Hypley.
SECTION 3 – SUPPLIER RULES AND RESTRICTIONS The information displayed on this Website concerning specific products and services is provided to us by the relevant suppliers or their agents (“Third Party Suppliers”). This includes, but is not limited to, information about prices, rules and availability and the description of the products. Hypley is not responsible for such information and we rely on the accuracy of the information supplied by the relevant Third Party Suppliers. If we become aware that the information provided by a Third Party Supplier is incorrect in any way, we reserve the right to correct any information (including, but not limited to, pricing information) and amend your booking (in consultation with you) to ensure that it reflects the correct price or otherwise complies with the correct information. Additional charges may be payable by you if you wish to proceed with the affected booking. Such charges will be advised to you at the time of consultation.
Additional terms and conditions imposed by the Third Party Suppliers may also apply to your booking and purchase of products and services, and we will advise you of these additional terms and conditions where the relevant Third Party Supplier provides them to us. Please read such additional terms and conditions carefully. You agree to abide by the terms and conditions imposed by any Third Party Supplier with whom you elect to deal, including, but not limited to, terms and conditions relating to the payment of all amounts when due, and compliance with the relevant Third Party Supplier’s rules and restrictions regarding availability and use of products or services. We reserve the right to cancel your booking if full payment is not received in a timely fashion.
Some Third Party Suppliers offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they offer. You understand that any violation of any such Third Party Supplier’s rules and restrictions may result in cancellation of your booking(s), in your being denied access to the applicable services and/or activities, in your forfeiting any monies paid for such booking(s), and/or in our debiting your account for any costs we incur as a result of such violation.
Hypley does not operate or control the products and services displayed on the Website. Nor does Hypley act as co-vendors with Third Party Suppliers with whom our customers book products or services.
SECTION 4 – PRICES, BILLING AND ACCOUNT INFORMATION You acknowledge and agree that your credit or debit card will be charged by Hypley or the supplier(s) with which your booking is made (as applicable) for the total booking price of the services in full at the time of the booking. This is the price displayed on the Website, plus taxes and service fees (where applicable). Prices may be subject to change without notice.
Commission for services and/or activities are subject to change without notice.
We reserve the right to refuse any booking you place with us. We may, in our sole discretion, limit or cancel quantities booked per household, business or per booking. These restrictions may include bookings placed by or under the same customer account, the same credit card, and/or bookings that use the same billing and/or booking address. In the event that we make a change to or cancel a booking, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the booking was made. You agree to provide current, complete and accurate credit card and account information for all bookings made on our site. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
SECTION 5 – BOOKING, CANCELLATION AND AMENDMENT CHARGES If you want to change any details of your reservation booked through the Website, we will do our best to help but cannot guarantee that changes will be permitted by the relevant Third Party Supplier.
Requests for a refund of monies paid for any products or services booked through the Website will be governed by the terms and conditions of the relevant Third Party Supplier, and Hypley is not responsible for, and does not have any control over, such terms and conditions.
Third Party Supplier may charge a fee in connection with any changes, which will be payable by you (if any). The price of your new arrangements will be based on the prices that apply on the day you ask us to make the change. These prices may not be the same as when you booked the products or services.
We reserve the right at any time to modify or discontinue the Services (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, commission change, suspension or discontinuance of the Services.
SECTION 6 – DISCLAIMER Hypley and its Third Party Suppliers make no representations about the suitability of the information, software, products, and services contained on this website for any purpose, and the inclusion or offering of any products or services on this website does not constitute any endorsement or recommendation of such products or services by Hypley. Hypley is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. Hypley has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond their direct control, and it has no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.
Nothing in these Terms & Conditions is intended to limit, exclude or modify or purport to limit, exclude or modify the statutory implied guarantees/warranties that cannot be lawfully limited, excluded or modified as provided under the Competition and Consumer Act 2010 including the statutory consumer guarantees under Australian Consumer Law or similar laws in the State and Territories of Australia.
SECTION 7 – LIMITATION OF LIABILITY In no event shall Hypley and its Third Party Suppliers be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, your access to, display of or use of this Website or with any delay or inability to access, display or use this Website (including, but not limited to, your reliance upon opinions appearing on this Website; any computer viruses, information, software, linked sites, products, and services obtained through this Website; or otherwise arising out of the access to, display of or use of this Website) whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if Hypley and its Third Party Suppliers have been advised of the possibility of such damages.
In relation to any liability which cannot be exclude by law or despite the limitation above, if Hypley and its Third Party Suppliers are found liable for any loss or damage which arises out of or in any way is connected with any of the occurrences described above, then Hypley and its Third Party Suppliers’ liabilities will in no event exceed, in the aggregate, the greater of (a) the service fees you paid to Hypley in connection with such transaction(s) on this website, or (b) One-Hundred Dollars (AU$100.00).
If any warranties are implied by law that cannot be excluded, then our liability for breach of such warranties is limited to, at our option:
- in the case of products:
1.1. the replacement of the products or the supply of equivalent products;
1.2. the payment of the cost of replacing the products or acquiring equivalent products;

2.1. the supply of the services again;
2.2. the payment of the cost of having the services supplied again.
SECTION 8 – INDEMNIFICATION – You agree to defend and indemnify Hypley and its Third Party Suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of (1) your breach of this Agreement; (2) your breach of any law or the rights of a third party; or (3) your use of this Website.

SECTION 14 – AGREEMENT This Agreement is governed by the laws of Queensland, Australia. You hereby consent to the exclusive jurisdiction of Queensland courts in all disputes arising out of or relating to the use of this Website or any bookings made. Use of this Website is unauthorised in any jurisdiction that does not give effect to all provisions of this Agreement including, without limitation, this paragraph.
Hypley may, and you may not, assign, convey, subcontract or delegate rights, duties or obligations hereunder. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Hypley as a result of this agreement or use of this Website.
Our performance of this Agreement is subject to existing laws and legal process, and nothing contained in this Agreement limits our right to comply with law enforcement requests or other requirements or legal requests relating to your use of this Website or information provided to or gathered by us with respect to such use. You agree that you will bring any claim or cause of action arising from or relating to your access or use of this Website within two (2) years from the date on which such claim or action arose or accrued or such claim or cause of action will be irrevocably waived.
If any part of this Agreement is found to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions will not in any way be affected or impaired. Our failure or delay in enforcing any provision of this Agreement at any time does not waive our right to enforce the same or any other provision(s) hereof in the future.
This Agreement (and any other terms and conditions referenced herein) constitutes the entire agreement between you and Hypley with respect to this Website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us with respect to this Website. What kind of personal information does Hypley use?
When you make a reservation, you’ll be asked for your name, address, telephone number, email address, payment details and your preferences for your booking. To make it easier to manage your reservations, you can open a user account. This allows you to save your personal settings, review previous bookings and manage future reservations. When you visit our website, even if you don’t make a reservation, we may collect certain information, like your IP address, or browser, and information about your computer’s operating system, application version, language settings and pages that have been shown to you. If you’re using a mobile device, we might also collect data that identifies your mobile device, device-specific settings and characteristics and latitude/longitude details. We may also receive information about you when you use certain social media services
Why does Hypley collect, use and share your personal data?
Reservations: First and foremost, we use your personal data to complete and administer your online reservation and forward your reservation details to the supplier you have booked.
Customer service: We provide international customer service 24/7 from our local office. Sharing your details with our global customer service allows for a quick response when you need us – including helping you find an appropriate services and any questions you might have about your reservation.
User reviews: We may use your contact information to invite you to write a user review after your booking. This can help other users choose a place to booking that suits them best.
Account administration: We offer a user account facility on our website. We use the information you give us to administer this, allowing you to manage your bookings, make future reservations more easily and manage your personal settings. Managing personal settings allows you to keep and share lists, share photos. It also allows you to see any reviews you submitted about vendors you booked with. If you want, you can share certain information in your user account by creating a public profile that’s associated with either your own first name or a screen name of your choice.
Marketing activities: We also use your information for marketing activities, as permitted by law. For example, when you make a reservation with us or set up a user account, we may use your contact information to send you news about similar rental-related products and services. We also send our customers regular newsletters by email. You can opt out, or unsubscribe, from marketing communication at any time. Based on the information you share with us, individualized offers may be shown to you on the Hypley website, in mobile apps or on third-party websites, including social media sites. When we believe that a particular offer may be of interest to you, we may decide to make contact with you by phone.

How does Hypley use social media?
We use social media to promote our services partners’ properties and to promote, improve and facilitate our own services website. For example, we integrated social media plugins into the Hypley website so when you click on one of the buttons and register with your social media account, information is shared with your social media provider, and possibly presented on your social media profile to be shared with others in your network. In addition to implementing these buttons, Hypley uses social media by maintaining accounts on several social media sites and by offering social apps. These social media services may allow you to share information with Hypley. When you register with a social media app, you’ll be told which information will be shared with Hypley. The information you choose to share with us may include the basic information that’s already available in your social media profile, email address, status updates and your friends list. This information is necessary to create a unique user experience either in the app itself or on our website. It facilitates things like personalising our website to suit your needs, connecting you with your friends on travel destinations and analysing and enhancing our booking-related services. How does Hypley share your data with third parties?

The item you booked: In order to complete your reservation, we need to transfer relevant reservation details to the services you booked with. This may include information like your name, contact and payment details and any preferences you specified when making a booking.
Third-party service providers: We may use third-party service providers to process your personal information on our behalf for the purposes specified above. For example, we may use service providers to send the reservation information on our behalf to the service item you just booked, or we may instruct third parties to contact you. When a reservation requires it, we may also work with third-party payment service providers to facilitate payment or payment guarantees. We also work with third-party advertisement networks to market our accommodation and services on other platforms, or involve third-party providers for analytical purposes. Business partners: We work with business partners to distribute or advertise services and to help our business partners distribute and advertise their services. This may mean that their services are integrated into our website or they have been enabled to show a customised advertisement on our website – or we are advertising on theirs. When you make a reservation on one of our business partners’ websites, certain personal data that you give them will be forwarded to us. Certain business partners may receive your personal data from us if requested by you. How does Hypley use mobile devices? (Is this relevant?)
We have free apps for a variety of mobile devices and use versions of our regular website that have been optimised for mobile. These apps and mobile websites process your personal details in a similar way as our website does – and they also allow you to use location services to find services nearby.
How does Hypley use user reviews and other destination-related information you share with us?
After you use any service booked through us, you’ll be invited to submit a user review, which may ask for information about the service item, the surrounding areas, and the destination. If you don’t want your name to show with your review, you can use your screen name (which you can choose in your user account) or it can be displayed anonymously. By completing a user review, you’re agreeing that it can be displayed (as further described in our Terms and Conditions) on, for example, the relevant service information page on our websites, in our mobile apps, in our social media accounts and in social apps, or on the website of the relevant property or on our business partner’s website, to inform others about the quality of the service item you used. If you indicate that a user review was helpful – or not helpful – we will aggregate this with feedback from other customers in order to sort and prioritise user reviews. We may use the information in your lists or in other rental-related information you share with us in an anonymous format to help other Hypley find the right destination.

Either directly or through service providers, we use these pixels as part of our online advertisements either on our website or on third-party websites to learn whether a user who is being shown an online advertisement also makes a reservation; to track conversion with partner websites and to analyse a user’s traffic patterns in order to optimize the travel-related services we bring to you.
What security procedures does Hypley put in place to safeguard your personal data?
In accordance with Australian data protection laws, we observe reasonable procedures to prevent unauthorized access and the misuse of personal information. We use appropriate business systems and procedures to protect and safeguard the personal information you give us. We also use security procedures and technical and physical restrictions for accessing and using the personal information on our servers. Only authorised personnel are permitted to access personal information in the course of their work. Your credit card details – when they are needed as part of the reservation process – are stored for a maximum of 10 days. After that, your credit card data will be either permanently deleted from our systems or will remain hashed in our system for fraud detection purposes. This is unless you have chosen to store your credit card details in your personal account.
The services offered by Hypley are not directed at children under 18 years old. The use of any of our services is only allowed with the valid consent of a parent or a guardian. If we receive information from a child under 18 years old, we reserve the right to delete it.
